1. Introduction & Who We Are
USA Models (“we,” “us,” or “our”) is a talent representation support service based in Parkland, Florida. We operate a lead-generation and application platform that connects families with opportunities in the modeling and entertainment industry.
This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our website or submit an application through our platform. It also describes the specific protections we apply to information about minors, consistent with the requirements of the Children's Online Privacy Protection Act (“COPPA”) and applicable federal and state law.
By using our website or submitting an application, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with any part of this Policy, please do not use our services.
To parents and guardians: If you are submitting an application on behalf of a minor child, please read this entire Policy carefully, with particular attention to Section 6 (Children's Privacy). Your consent is required before we may collect any information about your child.
2. Information We Collect
2.1 Information Submitted via Application Form
When a parent, guardian, or adult applicant submits a modeling application through our platform, we collect the information you voluntarily provide, which may include:
- Parent or guardian full name, email address, and phone number
- Your relationship to the applicant (e.g., parent, legal guardian)
- Physical location information (city, state, and ZIP code) to match applicants with regional opportunities
- Any additional details you provide in free-text fields
2.2 Child Applicant Information
COPPA Notice: We collect information about children under the age of 13 only with verified parental or guardian consent. Applications on behalf of minors must be submitted by a parent or legal guardian. We do not knowingly collect personal information directly from children.
Where you provide information about a child applicant, we may collect:
- The child's first name and last initial (or full name, as provided)
- The child's date of birth or age range
- The child's general physical characteristics relevant to modeling (e.g., height, eye color)
- Any special talents, skills, or experience you choose to share
We do not collect a child's Social Security number, school information, or any sensitive personal identifiers unless specifically required and separately disclosed.
2.3 Photos and Images
Our application process invites you to submit one or more photographs of the applicant for talent review purposes. By submitting a photo, you confirm that you are the parent or legal guardian of the child pictured and that you have full authority to submit the image on their behalf. Please refer to Section 4 (Photo & Image Handling) for details on how we store and use submitted images.
2.4 Automatically Collected Data
When you visit our website, we automatically collect certain technical information, including:
- IP address — used for fraud prevention, security monitoring, and aggregate analytics
- Browser type and version — used to ensure compatibility and improve user experience
- Operating system — used for technical troubleshooting and optimization
- Referring URL and pages visited — used to understand how visitors find and navigate our site
- Cookies and similar tracking technologies — please see Section 9 and our Cookie Policy for full details
This automatically collected data is used in aggregate, anonymized form where possible, and is not used to individually identify you unless necessary for fraud prevention or legal compliance purposes.
3. How We Use Your Information
We use the information we collect for the following purposes:
3.1 To Review Modeling Applications
Your submission is reviewed by our talent team to assess whether the applicant may be a good fit for modeling opportunities available through our network. This is the primary purpose for which your information is collected.
3.2 To Contact You About Opportunities
If our team determines that an applicant may be suitable for representation or a specific opportunity, we will contact you using the phone number and/or email address provided. We will not share your contact details with third-party agencies or clients without first obtaining your explicit consent.
3.3 Marketing Communications
With your separate, affirmative consent, we may send you informational and promotional communications about USA Models services, industry news, or upcoming opportunities. You may withdraw this consent at any time by clicking “unsubscribe” in any marketing email or by contacting us directly at privacy@usa-models.com.
3.4 Fraud Prevention and Security
We use collected information, including IP addresses and application details, to detect and prevent fraudulent submissions, spam, and abuse of our platform. This helps us maintain the integrity of our application process and protect the families who use our services.
3.5 Legal Compliance
We may use or disclose your information as required to comply with applicable laws, regulations, legal processes, or enforceable governmental requests, or to protect the rights, property, or safety of USA Models, our users, or the public.
3.6 Service Improvement
We use aggregated, anonymized data to analyze usage patterns, improve our platform, and enhance our services. This analysis does not involve identifying individual applicants.
4. Photo & Image Handling
Because our service involves photographs of children, we apply heightened care to how images are stored, accessed, and used.
4.1 Secure Storage
All photos submitted through our platform are stored on secure, encrypted servers. We use industry-standard encryption both in transit (TLS/HTTPS) and at rest to protect submitted images from unauthorized access.
4.2 Limited Access
Submitted photos are accessible only to authorized USA Models talent review staff on a need-to-know basis. Access is governed by role-based permissions and logged for audit purposes. We do not permit general staff, contractors, or third parties to view submitted photos unless expressly authorized and subject to confidentiality obligations.
4.3 No Public Display Without Consent
Submitted photos will not be displayed publicly, used in advertising materials, featured on our website, or shared on social media without your separate, written consent. The submission of a photo for application review does not constitute consent to any public use.
4.4 Sharing with Agencies and Clients
If you proceed to the next stage of the talent review process and consent to your child being presented to modeling agencies or clients, we will share your application — including submitted photos — only after you have provided explicit, informed consent. This consent will be obtained separately and may be withdrawn at any time prior to sharing.
4.5 Retention
Submitted photos and associated application data are retained for a period of 12 months from the date of application, unless you request earlier deletion. After 12 months, photos are permanently deleted from our servers unless you have entered into an active representation or referral relationship with us and have consented to extended retention.
To request deletion of a photo before the standard retention period expires, please contact us at privacy@usa-models.com.
5. Sharing Your Information
5.1 Modeling Agencies and Industry Clients
We may share your application information — including your child's details and submitted photos — with modeling agencies, casting directors, or clients who may have opportunities suitable for your child. We will only do this after obtaining your explicit, informed consent. We do not share application information speculatively or in bulk.
5.2 Service Providers
We engage trusted third-party service providers to assist us in operating our platform. These may include:
- Cloud hosting and storage providers — for secure data and image storage
- Customer relationship management (CRM) software — for organizing and tracking applications
- Email and SMS communication providers — for contacting applicants
- Analytics providers — for understanding website performance (see Section 9)
All service providers are subject to written data processing agreements that prohibit them from using your information for any purpose other than providing services to us, and that require them to maintain appropriate security measures.
5.3 We Do Not Sell Your Information
USA Models does not sell, rent, trade, or otherwise transfer your personal information — or your child's personal information — to third parties for their own marketing or commercial purposes. Ever.
5.4 Legal Requirements
We may disclose information when required by law, court order, or government authority, or when we have a good-faith belief that disclosure is necessary to protect the safety of any person or to prevent illegal activity.
5.5 Business Transfers
In the event of a merger, acquisition, reorganization, or sale of all or substantially all of our assets, your information may be transferred to the acquiring entity. We will notify you via email and/or a prominent notice on our website if this occurs, and we will require the acquiring entity to honor this Privacy Policy or obtain your consent to any material changes.
6. Children's Privacy (COPPA)
Important: This section addresses our practices with respect to personal information of children under the age of 13, consistent with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506, and the FTC's implementing rule, 16 C.F.R. Part 312.
6.1 Applications Must Be Submitted by Parents or Guardians
Our services are directed to parents and guardians who wish to explore modeling opportunities for their minor children. We do not accept applications submitted directly by children under the age of 18. By submitting an application, you represent and warrant that you are the parent or legal guardian of the child applicant and that you are at least 18 years of age.
6.2 Parental Consent for Children Under 13
For children under the age of 13, we obtain verifiable parental consent prior to collecting, using, or disclosing the child's personal information. By completing and submitting an application on behalf of a child under 13, you are providing this consent. Your consent covers the collection and use of information as described in this Privacy Policy.
We do not condition a child's participation in our review process on the disclosure of more personal information than is reasonably necessary for that participation.
6.3 Parental Rights
As the parent or legal guardian of a child applicant, you have the following rights with respect to your child's information:
- Right to Review: You may request a copy of the personal information we have collected about your child.
- Right to Correct: You may request that we correct inaccurate information about your child.
- Right to Delete: You may request that we delete your child's personal information from our records. We will honor such requests promptly, except where retention is required by law.
- Right to Refuse or Withdraw Consent: You may refuse to permit further collection of your child's information or withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of any collection or use that occurred prior to your withdrawal.
To exercise any of these rights, please contact us at privacy@usa-models.com or by calling 954-369-2072.
6.4 If We Learn We Have Collected Information Without Proper Consent
If we discover that we have inadvertently collected personal information from a child under 13 without verifiable parental consent, we will take immediate steps to delete that information from our records. If you believe we have collected your child's information without your consent, please contact us immediately.
7. Your Rights
Regardless of where you are located, you have the following rights with respect to your personal information:
- Right of Access: You may request a copy of the personal information we hold about you.
- Right to Rectification: You may request that we correct any inaccurate or incomplete information.
- Right to Erasure: You may request that we delete your personal information from our records, subject to any legal retention obligations.
- Right to Withdraw Consent: Where we process your information based on your consent, you may withdraw that consent at any time. This does not affect the lawfulness of processing prior to withdrawal.
- Right to Restrict Processing: In certain circumstances, you may request that we limit our use of your information.
- Right to Object: You may object to our processing of your information for direct marketing purposes at any time.
To exercise any of these rights, please contact our privacy team at privacy@usa-models.com. We will respond to your request within 30 days. We may need to verify your identity before processing your request.
We will not discriminate against you for exercising any of your privacy rights.
8. Security
We take the security of your personal information — and your child's information — seriously. We implement a range of technical, administrative, and physical safeguards designed to protect against unauthorized access, disclosure, alteration, or destruction of the information we collect.
These measures include:
- Encryption in transit: All data transmitted between your browser and our servers is encrypted using TLS (Transport Layer Security).
- Encryption at rest: Stored personal information and submitted photos are encrypted at rest using industry-standard encryption.
- Access controls: Access to personal data is restricted to authorized USA Models personnel on a strict need-to-know basis, enforced through role-based access controls.
- Secure file storage: Uploaded photos are stored in access-controlled, encrypted cloud storage environments.
- Regular security reviews: We periodically review our security practices and update them to address emerging threats.
While we make every reasonable effort to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you in accordance with applicable law.
9. Cookies
We use cookies and similar tracking technologies to operate our website, understand how visitors use our platform, and (with your consent) deliver relevant marketing. Cookies are small text files stored on your device.
We use essential cookies (necessary for the site to function), analytics cookies (to understand usage patterns), and, with your consent, marketing cookies. For a full description of the cookies we use and how to control them, please see our Cookie Policy.
10. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the “Effective Date” at the top of this page and, where appropriate, notify you by email or by posting a prominent notice on our website.
We encourage you to review this Policy periodically. Your continued use of our website or services after any changes constitutes your acceptance of the updated Policy.
